General Terms and Conditions for the Use of the Frosty Farms Online Shop.

§ 1 Scope of Application

These General Terms and Conditions (GTC) apply in the version valid on the day of the order to all purchase contracts for publications (brochures, collective agreements, etc., in paper or digital form) between the Frosty Farms Shop and its customers. By placing an order, the customer agrees to these GTC and is bound by them.
If individual provisions of these GTC are or become invalid due to mandatory legal regulations (especially those under the Austrian Consumer Protection Act, KSchG), the remaining provisions shall remain unaffected.

§ 2 Conclusion of Contract

All offers from the Frosty Farms Shop (order lists, webshop, etc.) are non-binding and to be understood as invitations to the customer to submit an offer. The contract is concluded upon acceptance of the customer's order by the Frosty Farms Shop, either by sending an order confirmation (via email or post) or by dispatching the ordered goods.

§ 3 Right of Withdrawal

Customers who are consumers under the Austrian Consumer Protection Act (KSchG) have the right to withdraw from the purchase within 14 days of receiving the goods without stating any reason. It is sufficient if the notice of withdrawal is sent within this period.
In the event of withdrawal, a refund of the purchase price will only be made concurrently with the return of the goods received by the customer. A condition for this is that the goods are unused and in a condition suitable for resale as new. The cost of return shipping is to be borne by the customer.
For items that show signs of use or are damaged, Frosty Farms Shop reserves the right to charge a reasonable fee for depreciation. The same applies if accessories (such as bags, etc.) are missing upon return.
There is no right of withdrawal for services delivered online (e.g. consulting) or for software that has been unsealed by the buyer.
The customer has no right of withdrawal for goods made to order or clearly tailored to personal needs, for items not suitable for return due to their nature, perishable goods, or items with expired expiry dates, as well as for audio/video recordings or software if the seal has been broken, and for newspapers, magazines, or illustrated publications (with the exception of subscription contracts under § 26 (1) no. 1 KSchG).

§ 4 Prices

The purchase price valid at the time of the order, as listed in the current price lists, webshop, or similar publications of the Frosty Farms Shop, shall apply. Depending on the customer's status, the prices stated in the price list or online shop shall apply.
Unless otherwise stated, all prices include VAT and exclude shipping costs.

§ 5 Delivery Conditions

Delivery is normally made within 3–5 working days after receipt of payment but no later than 15 days. If the ordered goods are unavailable, the customer will be informed without delay.
As of November 1, 2020, flat-rate shipping costs of €20 including VAT per delivery apply, depending on the destination country. Shipping costs are shown during checkout.

§ 6 Terms of Payment

Payment is made in advance via bank transfer.

§ 7 Warranty

The warranty is provided according to legal regulations and is valid for 24 months from receipt of the goods. If replacement or repair is not possible or reasonable (due to excessive effort, delay, etc.), the buyer is entitled to a price reduction or, if the defect is not minor, contract cancellation (rescission). Compensation for consequential damages, property damage, financial losses, or third-party claims (if not a consumer transaction) is excluded.

§ 8 Transport Damage

If goods are delivered with obvious transport damage, the customer is requested to report such damage to the delivery service immediately and to contact the seller as soon as possible.
Failure to make a complaint or contact us does not affect the customer’s statutory warranty rights but helps the seller assert claims against the shipping provider or insurance.

§ 9 Liability for Damages

The Frosty Farms Shop is only liable for damages caused by intent or gross negligence, except in cases of personal injury. In non-consumer transactions, the burden of proving gross negligence lies with the injured party.
Compensation for consequential or purely financial losses is excluded for business customers.
Frosty Farms Shop accepts no liability for the formal or substantive accuracy of the information in its publications.

§ 10 Retention of Title

Delivered goods remain the property of the seller until full payment has been received.

§ 11 Liability

Statutory liability provisions apply.

§ 12 Data Protection

The customer acknowledges that personal data provided in the contract will be stored and processed for accounting and customer management purposes. The data is used to fulfill legal obligations and handle payment transactions. Customer data will not be shared with third parties unless necessary for contract fulfillment.

§ 13 Jurisdiction and Applicable Law

This contract is governed by Austrian substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer, the mandatory consumer protection provisions of the country of residence shall also apply. The place of performance is the registered office of the Sonnenblatt Shop.
The competent court at the seller’s place of business shall have exclusive jurisdiction for disputes. If the customer is a consumer, jurisdiction is based on the court covering the customer’s residence, habitual location, or workplace, as per the Austrian Consumer Protection Act.
